Acceptable Use Policy

This Acceptable Use Policy (“AUP”) describes conduct that is prohibited on the Victor Platform (the “Service”), operated by Victor Markus LLC (“Company,” “we,” “us,” or “our”). It applies to everyone who accesses the Service, including account owners, property managers, team members, contractors, vendors, tenants, and investors.

This AUP supplements and is incorporated into our Terms of Service, and expands on Section 6 (Acceptable Use) of those Terms. Capitalized terms not defined here have the meaning given in the Terms. Where this AUP and the Terms conflict, the Terms control.

Victor is a tool. You remain responsible for how you run your business, and using the Service does not transfer any of your legal obligations to us. Nothing in this AUP is legal advice.

1. Fair Housing and Non-Discrimination

This is the most important section of this policy. The federal Fair Housing Act, and many state and local laws that go further, prohibit discrimination in the sale, rental, advertising, and financing of housing. You are solely responsible for your compliance.

You must not use the Service to:

  • Refuse to rent, negotiate, or otherwise make housing unavailable, or apply different terms, on the basis of race, color, religion, national origin, sex (including sexual orientation and gender identity), familial status, or disability, or on the basis of any other characteristic protected under applicable state or local law, which in many jurisdictions includes source of income, age, marital status, military or veteran status, immigration status, or criminal history;
  • Create, store, or publish listings, advertisements, descriptions, or outreach that state or imply a preference, limitation, or discrimination based on a protected characteristic, including coded or indirect language such as describing a neighborhood or an “ideal tenant” in those terms;
  • Filter, sort, score, target, or exclude applicants or prospects using a protected characteristic, or using a proxy that functions as a stand-in for one;
  • Apply a blanket policy that has an unjustified discriminatory effect, including categorical exclusions based on criminal history or source of income where such policies are restricted; or
  • Retaliate against any person for asserting fair housing rights or filing a complaint.

You must also make and process reasonable accommodation and reasonable modification requests for people with disabilities in accordance with applicable law, whether or not the Service provides a specific feature for doing so.

2. AI Features and Markus

The Service includes AI features, including the assistant known as Markus. AI output is generated automatically, may be incomplete or wrong, and is not reviewed by a human before you see it.

  • You must review AI output before acting on it or sending it to anyone. This applies with particular force to listings, tenant communications, notices, lease language, contracts, screening decisions, and anything describing a person.
  • Do not use AI features to make, or to substantially automate, a decision to approve or deny a housing application, set differential terms, or initiate an eviction. A person must make those decisions.
  • Do not use AI features to generate content that is discriminatory, harassing, deceptive, defamatory, or that infringes anyone’s rights.
  • Do not attempt to manipulate AI features into bypassing the Service’s access controls, revealing another person’s data, or producing prohibited content, including through prompt injection or content planted in uploaded files.
  • AI-generated documents, including contracts, are drafts. They are not legal advice and are not binding until reviewed by a qualified attorney and signed by the parties.

3. Tenant Screening and Consumer Reports

If you use the Service in connection with tenant screening, background checks, credit reports, or other consumer reports, you are responsible for complying with the Fair Credit Reporting Act and equivalent state laws. You must not:

  • Obtain or use a consumer report without a permissible purpose and any required written consent;
  • Fail to give required adverse action notices when you deny an application, increase a deposit, or otherwise act unfavorably based in whole or in part on a report;
  • Store consumer report data in the Service beyond what your retention obligations permit, or share it with anyone lacking a permissible purpose; or
  • Use screening data for any purpose other than evaluating the tenancy it was obtained for.

4. Other People’s Data

Much of what is in your account describes people who are not you: tenants, applicants, contractors, and co-investors. Treat it accordingly. You must not:

  • Upload personal information you do not have a lawful basis to hold, or that you obtained without required notice or consent;
  • Invite someone to a property, project, or team in order to expose them to another person’s information that they have no legitimate need to see;
  • Share, export, or sell tenant, applicant, or contractor data to third parties for marketing or any purpose unrelated to the tenancy, project, or investment it was collected for;
  • Upload payment card numbers, full bank account and routing numbers, Social Security numbers, government identification numbers, or health information into free-text fields, notes, documents, photos, or messages. Use the dedicated integrations for payment and bank data; or
  • Use the Service to conduct surveillance of tenants or staff, or to record anyone without the consent required by law.

5. Communications

The Service can send email and other messages on your behalf. You are the sender. You must not use it to:

  • Send messages to people who have not given the consent required by applicable law, including the Telephone Consumer Protection Act and CAN-SPAM;
  • Send bulk unsolicited marketing, chain messages, or anything a reasonable recipient would call spam;
  • Send harassing, threatening, abusive, obscene, or intimidating messages, including in the course of rent collection;
  • Misrepresent who you are, forge headers, or send messages that appear to come from Victor Markus LLC or from another user; or
  • Conduct debt collection in a manner prohibited by the Fair Debt Collection Practices Act or applicable state law, including contacting people at prohibited times, misstating amounts owed, or threatening action you cannot lawfully take.

You must honor opt-out requests promptly, except for transactional and legally required communications such as lease notices.

6. Payments, Banking, and Financial Data

The Service integrates third-party payment and bank-linking providers. Your use of those features is also governed by the applicable provider’s terms and acceptable use policy, and those providers may suspend service independently of us. You must not use the Service to:

  • Process payments for any business or activity prohibited by the applicable payment provider;
  • Launder money, evade sanctions, structure transactions to avoid reporting, or finance illegal activity;
  • Link a bank account you are not authorized to access, or link an account on another person’s behalf without their authorization;
  • Collect rent, deposits, or fees that are unlawful in the applicable jurisdiction, including deposits over statutory caps and fees that are prohibited or undisclosed;
  • Commingle security deposits contrary to applicable law, or misrepresent how deposit funds are held; or
  • Route funds to a contractor or vendor without a genuine underlying transaction, or issue invoices for work that was not performed.

7. Platform Integrity and Security

You must not:

  • Attempt to access any account, property, project, organization, or data that you have not been granted access to, including by probing or circumventing access controls or row-level security;
  • Share account credentials, or let another person use your account;
  • Scrape, crawl, harvest, or bulk-export data from the Service by automated means, except through interfaces we provide for that purpose;
  • Upload malware, or content designed to disrupt, disable, or impair the Service or any connected system;
  • Reverse engineer, decompile, or attempt to derive source code, except where that restriction is unenforceable under applicable law;
  • Impose an unreasonable load on the Service, circumvent rate limits or usage caps, or use it to run workloads unrelated to managing your properties, projects, or investments; or
  • Resell, sublicense, or provide the Service to third parties as a service bureau without a written agreement with us.

Security research. We welcome good-faith reports of vulnerabilities. Do not test against accounts or data that are not yours, do not exfiltrate data beyond the minimum needed to demonstrate an issue, and report what you find to security@victormarkus.com before disclosing it. See our Security page.

8. Content

You must not upload, store, or transmit content that:

  • Infringes anyone’s copyright, trademark, or other intellectual property rights, including listing photographs you do not have rights to use;
  • Is defamatory, obscene, or sexually explicit;
  • Depicts or exploits minors;
  • Promotes violence, or targets any person or group for harassment; or
  • You do not have the right to upload under a contract, court order, or applicable law.

9. Enforcement

We may investigate suspected violations and may suspend or terminate access, remove content, disable a feature, or report conduct to law enforcement or a relevant regulator. Where practical and lawful we will give notice and an opportunity to correct the problem first, but we may act immediately without notice where there is a risk of harm to a person, to other users, to the Service, or where a payment or banking provider requires it.

Enforcement is at our discretion. Choosing not to act in one instance does not waive our right to act in another. Suspension for a violation does not entitle you to a refund.

10. Reporting a Violation

To report a violation of this AUP, including a fair housing concern or a suspected security issue, contact us at support@victormarkus.com. Please include enough detail for us to identify what happened. Security issues should go to security@victormarkus.com.

A report to us is not a substitute for any legal remedy available to you. Housing discrimination complaints may be filed with the U.S. Department of Housing and Urban Development or your state or local fair housing agency, regardless of anything in this policy.

11. Changes to This Policy

We may update this AUP as the Service changes and as legal requirements evolve. We will update the Last Updated date above, and will give notice of material changes where required. Continuing to use the Service after a change takes effect means you accept the updated policy.
